Colton Asphalt Paving provides asphalt paving, sealcoating, repair, striping, and related services to residential and commercial customers in Colton, CA and surrounding communities. The specific scope, pricing, and timeline of any project are determined through a separate written agreement or estimate provided directly to the customer.
Nothing on this Site constitutes a binding offer or contract for services. All service agreements require a signed estimate or written authorization from both parties.
Any estimate or quote provided by Colton Asphalt Paving - whether in person, by phone, by email, or through the website - is valid for 30 days from the date issued unless otherwise stated in writing. Estimates are based on conditions visible at the time of the site visit. Changes in project scope, site conditions, material costs, or access issues discovered during work may require a revised estimate and written authorization before work continues.
Prices quoted do not include permit fees, utility markings, or other third-party costs unless explicitly stated in the written estimate.
Work dates are confirmed in writing or by mutual agreement. We reserve the right to reschedule work due to weather conditions, equipment availability, or other circumstances outside our control. We will notify you as promptly as possible if a scheduled date needs to change.
If you need to cancel or reschedule a confirmed project, please notify us at least 48 hours in advance. Cancellations made after materials have been ordered or mobilization has begun may be subject to costs already incurred.
Payment terms are specified in the written estimate or project agreement. Unless otherwise agreed in writing, payment is due upon project completion. For larger projects, we may require a deposit before work begins; this will be stated in your written estimate.
Invoices not paid within 30 days of the due date may be subject to a late fee of 1.5% per month on the outstanding balance, or the maximum rate permitted by California law, whichever is less. You agree to pay all reasonable costs of collection, including attorney fees, if your account is referred to collections.
We stand behind our work. Any warranty on labor or workmanship will be stated in the written project agreement. Warranties apply only to the work performed by Colton Asphalt Paving and do not cover damage caused by third parties, improper use, acts of nature, or conditions that existed before we began work.
Material warranties, if any, are governed by the terms of the material manufacturer and are separate from any warranty we provide on labor. No warranty is implied beyond what is stated in writing.
You agree to provide safe and clear access to the work area on the scheduled date. This includes removing vehicles, personal property, or obstructions from the work zone. If access is unavailable or unsafe on the scheduled day and work cannot proceed, we reserve the right to charge a trip fee for the mobilization.
You are responsible for notifying us of any underground utilities, irrigation systems, or other subsurface features in the work area that are not otherwise marked. We are not liable for damage to unmarked utilities or features we were not informed about.
To the fullest extent permitted by California law, Colton Asphalt Paving's total liability for any claim arising out of or related to our services or this Site shall not exceed the amount actually paid by you for the specific service giving rise to the claim.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of use, loss of business, or loss of revenue, even if we have been advised of the possibility of such damages.

Class action proceedings are waived. You and Colton Asphalt Paving each agree to resolve disputes individually.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought in a court of competent jurisdiction in California.
